Absolute bullshit.

* Discussing actions taken against players in public.
* Trying to enforce an ingame eula/tos based upon comments made out of game (nope, didn't sign an eula/tos agreement when I arrived at fanfest)
* Only taking actions when it became evident that bad press was happening (thus only 'starting' investigations 3 days after the comment was livestreamed, when there were multiple CCP, Sony and Press Reps watching the Alliance panel).

All irrelevant. The CSM was created as a PR entity after the T20 faisco, and anything that relates to it is essentially a question of politics and PR. Mittani is(was) a public figure for CCP and, like real life politics, normal rules not apply to public figures.

Like I posted here a few days ago, CCP essentially had to do a cost-benefit analysis of what Mittani had to offer to further its goal of recruiting and retaining subscriptions. They have now decided.
